Firm Files Antitrust Suit Against Railroads for Price Fixing

The Firm filed an antitrust suit on behalf of its client, Air Products and Chemicals, Inc., against the four largest railroad companies in the United States for an alleged price fixing conspiracy. The complaint alleges violations of Section 1 of the Sherman Act, 15 U.S.C. § 1, and Section 4 of the Clayton Act, 15 U.S.C. § 15, for Defendants’ conduct in jointly and artificially increasing the prices Air Products and Chemicals paid Defendants to ship products by rail. The action was originally filed in the Eastern District of Pennsylvania before being transferred to the pending MDL of related antitrust cases in the District of Columbia. The action is proceeding through discovery.
